Payment, Cancellation & Refunds – Terms & Conditions

Payment Terms

  1. All prices are quoted in Australian Dollars (AUD) and are exclusive of GST unless stated otherwise.
  2. A deposit of [insert % or amount] may be required prior to commencement of works. No booking is confirmed until the deposit is received.
  3. The remaining balance is payable upon completion of works or as otherwise stated on the invoice.
  4. Payment must be made via approved payment methods including bank transfer, credit/debit card, or other methods as agreed.
  5. Late payments may incur reminder notices and/or suspension of future services until the account is brought up to date.

Deposits

  1. Deposits secure labour, materials, scheduling, and site allocation.
  2. Deposits are non-refundable once work has commenced or materials have been ordered specifically for the job.
  3. Where work has not yet commenced, deposit refunds (if any) are subject to Clause 4 (Cancellations).

Variations & Additional Works

  1. Any additional work requested or required beyond the original scope will be treated as a variation.
  2. Variations may incur additional costs and/or time extensions.
  3. All variations must be approved by the client prior to commencement, where reasonably practicable.

Cancellations

  1. Cancellations made within 24 hours of the scheduled start date may incur a cancellation fee of up to $250, or loss of deposit, to cover labour allocation and administrative costs.
  2. Cancellations made after work has commenced are not eligible for refunds.
  3. If Kingsmen Marine is unable to proceed due to unforeseen circumstances, a rescheduled date will be offered or a refund provided for any unused portion of the deposit at Kingsmen Marine’s discretion.

Refund Policy

  1. Kingsmen Marine does not offer refunds for change of mind.
  2. Refunds will only be considered where services have not been supplied or where required under Australian Consumer Law.
  3. Where a refund is approved, it will be limited to the portion of work not yet completed, less any costs already incurred (labour, materials, travel, equipment hire).
  4. No refunds are provided for:
  • Completed services
  • Labour already performed
  • Consumables used
  • Environmental or site-related delays outside Kingsmen Marine’s control

Australian Consumer Law

Nothing in these terms excludes, restricts, or modifies any consumer guarantees, rights, or remedies available under the Australian Consumer Law (ACL).

Access & Delays

  1. The client must provide safe and reasonable access to the vessel/worksite.
  2. Delays caused by weather, marina access restrictions, third-party contractors, or safety requirements do not entitle the client to a refund.
    3. Stand-down time caused by access issues or client delays may be chargeable.

Ownership & Possessory Rights

  1. Kingsmen Marine reserves the right to withhold release of the vessel or completed works where invoices remain unpaid, to the extent permitted by law.
  2. Any recovery or legal costs incurred in relation to unpaid invoices may be recoverable from the client.

Acceptance of Terms

 Engaging Kingsmen Marine, approving a quote, or making payment constitutes acceptance of these Payment, Cancellation & Refunds Terms and Conditions.
